General Terms and Conditions with Customer Information

1. Scope of Application

These General Terms and Conditions apply to all contracts concluded between Maison Maghrebi, hereinafter referred to as the “Seller”, and customers via the online shop at www.maisonmaghrebi.com.

Any terms and conditions of the customer shall not apply unless we have expressly agreed to them.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to independent professional activity. An entrepreneur is any natural or legal person who acts in the exercise of their commercial or independent professional activity.

2. Conclusion of Contract

The product descriptions in our online shop do not constitute binding offers. They serve to enable the customer to submit a binding order.

The customer can submit a binding purchase offer via the online checkout system. Before submitting the order, the customer can review and correct all entered information.

By clicking the final order button, such as “Buy now”, “Order with obligation to pay” or a similar button, the customer submits a binding offer to purchase the goods in the shopping cart.

After placing the order, the customer receives an automatic order confirmation by email. The contract is concluded once we accept the order by email, process the order, request payment or dispatch the goods.

Order processing and communication usually take place by email. The customer must ensure that the email address provided is correct and that emails from us can be received.

3. Right of Withdrawal

Consumers are generally entitled to a right of withdrawal. Further information can be found in our withdrawal policy.

4. Prices and Payment Conditions

All prices stated in the online shop include statutory VAT where applicable. Additional delivery and shipping costs may apply and will be displayed during the checkout process.

The available payment methods are shown in the online shop during checkout.

If advance payment is agreed, payment is due immediately after conclusion of the contract.

Payment via Stripe

If a payment method offered via Stripe is selected, payment processing is carried out by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.

Stripe may use additional payment services for payment processing. Any special payment conditions will be displayed separately during the checkout process.

5. Delivery and Shipping Conditions

Goods are delivered to the shipping address provided by the customer during the order process.

If delivery to the customer is not possible and the goods are returned to us, the customer shall bear the costs of the unsuccessful delivery, unless the customer is not responsible for the failed delivery.

Self collection is not possible for logistical reasons.

6. Retention of Title

The goods remain our property until the purchase price has been paid in full.

7. Liability for Defects

The statutory liability rights for defects apply.

Customers are asked to check the goods upon delivery for completeness, obvious defects and transport damage, and to notify us as soon as possible. Failure to do so does not affect statutory warranty rights.

8. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

9. Final Provisions

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.
